Our services may depend on platforms such as Google, Meta, analytics providers, CRM systems, hosting providers, payment processors, and AI providers. Their availability, policies, algorithms, approvals, pricing, and functionality are outside our control.

4. Advertising Results Disclaimer

Marketing performance varies based on industry, competition, budget, offer, market conditions, creative assets, landing pages, tracking, audience behavior, platform changes, and other factors. We do not guarantee specific leads, sales, revenue, rankings, advertising results, or return on investment unless expressly stated in a written agreement.

5. Client Responsibilities

Clients are responsible for accurate information, timely approvals, required platform access, lawful products and services, and materials needed to perform agreed services.

6. Advertising Compliance

Clients remain responsible for ensuring their products, claims, offers, websites, promotions, and supplied materials comply with applicable laws, regulations, platform rules, and industry requirements.

7. Client Materials & Intellectual Property

You represent that you have the necessary rights to materials supplied to us. NewGen Pro retains rights in its pre-existing materials, systems, templates, processes, know-how, and tools. Client-owned materials remain the client's property. Deliverable rights are governed by the applicable agreement and payment status.

8. AI-Powered Services

AI tools may be used for content, automation, customer engagement, analysis, or other services. AI output may require human review and may contain errors or limitations.

9. Fees and Payment

Fees, payment schedules, advertising budgets, third-party charges, taxes, and other costs will be stated in the applicable proposal or agreement. Advertising spend is separate from service fees unless specifically included.

10. Cancellation and Termination

Cancellation and termination are governed by the applicable service agreement. We may suspend or terminate services for non-payment, misuse, unlawful activity, material breach, or circumstances that make continued performance impractical.
